While New York State does not permit the expungement of convictions, New York State does permit the "sealing" of cases where criminal charges were dismissed, vacated, set-aside, not filed, or otherwise terminated. New York, does not, however, allow expungement or "sealing" of cases where a conviction was entered, except in the case of certain older controlled substance, marijuana and loitering offenses. The "sealing" of a record prevents the public from having access to or viewing the records, which include fingerprint cards, photographs, court entries, and other information relating to a case. The record may still be made available to courts and law enforcement personnel.
